1. Copyright & Ownership
All images created by C. Smith Photography are protected under United States copyright law. The Photographer retains full copyright ownership of all photographs.
Purchasing a digital image grants the buyer a personal-use license only, not ownership of the image.
Images may not be:
Edited, altered, or filtered
Cropped to remove watermark
Sold or used for commercial purposes
Submitted to contests or publications without written permission
2. Payment & Downloads
All digital downloads must be purchased before access to high-resolution files is granted.
No images may be downloaded, printed, or reproduced without payment.
Prices are subject to change at any time.
Once digital files are delivered, sales are final.
3. Screenshots & Unauthorized Use
Screenshots, screen recordings, or reproduction of preview images without purchase are strictly prohibited.
Watermarked gallery previews are for viewing purposes only.
Unauthorized use of images may result in:
Invoice for full purchase price
Removal request
Legal action if necessary
4. Personal Use License
Purchased images may be used for:
Personal social media posts
Personal prints
Sharing with family members
When posting on social media, credit to:
C. Smith Photography
Images may not be used for:
Advertising
Fundraising promotions
Business marketing
Merchandise
Without written permission.
5. School & Event Photography
Photographs are taken at public or school-sponsored events where there is no reasonable expectation of privacy. Parents/guardians who do not wish their child to be photographed must notify the Photographer or school administration in writing prior to the event.
6. Refund Policy
Due to the digital nature of products:
All sales are final.
No refunds will be issued once digital files are delivered.
Print orders are subject to the print lab’s reprint policies for defects only.
7. Image Delivery
High-resolution digital images will be delivered via online gallery download after payment confirmation.
The Photographer is not responsible for lost downloads after 30 days of gallery expiration.
8. Limitation of Liability
The Photographer is not liable for:
Missed moments due to schedule conflicts
Weather conditions
Restricted access at school events
Technical malfunctions beyond reasonable control
9. Agreement
By accessing the gallery and/or purchasing images, the client agrees to these Terms of Service.
